Love to Dream – Arms Up US Giveaway  

The Giveaway will run from 12:01 a.m., PST Time, on Saturday March 1st, 2025 through 12 p.m., PST Time, on Monday March 31st, 2025. 

Official Rules 

Purpose. These Arms Up US Giveaway Official Rules (the “Rules”), together with Love to Dream’s Terms of Service, govern the Arms Up US Giveaway (the “Giveaway”). In the event of any conflict between these Rules and the Terms of Service, these Rules shall govern such conflict. 

By entering into the Giveaway, you fully and unconditionally agree to be bound by these Rules and the Terms of Service and represent that you satisfy all eligibility requirements for the Giveaway. 

Sponsor. The Giveaway is sponsored by Love to Dream, Inc. (“Sponsor” or “Love to Dream”). The Giveaway is not sponsored or administered by any other company (including, without limitation, Instagram or Facebook, which are not associated with and do not endorse the Giveaway. By entering the Giveaway, you agree to release Instagram, Facebook (Meta), TikTok and YouTube (Google) of any obligation, expectation, claim, or liability of any kind in connection with your entry or the Giveaway. 

Binding Agreement. As described above, in order to enter or participate in the Giveaway, and to potentially receive a prize package (as defined below), you must fully and unconditionally agree to be bound by these Rules and the Terms of Service. By entering the Giveaway, you represent that you have read these Rules and the Terms of Service prior to your entry and that you fully and unconditionally understand and agree to them. 

Eligibility. To be eligible to enter the Giveaway, you must be an individual, natural person not acting on behalf of or at the behest of any entity or business, at least eighteen (18) years old, and a legal resident of the United States. Employees, officers, and directors of Sponsor and their immediate family members (i.e., parents, children, spouses or partners, grandparents, grandchildren, aunts, uncles, nieces, or nephews), are not eligible to enter the Giveaway. Residents of Rhode Island are not eligible to participate in the Giveaway. Individuals who participate in the Giveaway but are not eligible for these reasons, or for any reason under statutory or common law, or any rule or regulation, shall have any award canceled, and they must, in Sponsor’s discretion, return any prize package mistakenly delivered to them. The winner of the Family Sleep Fund (the ‘Major Prize’) must provide evidence (e.g. birth certificate, ultrasound scan, doctors certificate) confirming they are a current parent (or their immediate relation) of one or more children under 4 years of age or an expectant parent (or their immediate relation) with a due date in 2025. 

How to Enter. Participation in the Giveaway is voluntary and does not require you to purchase anything from Sponsor or any other brand. You can gain entries to the Giveaway in one or more of the following ways: 

  1. Earn one entry by signing up to Love to Dream’s database by following the instructions outlined at: https://lovetodream.com/pages/arms-up-giveaway (the “Giveaway Website”). This will result in one entry. You are limited to one entry using this method. 
  2. Earn additional entries for completing actions outlined at:  https://lovetodream.com/pages/arms-up-giveaway. (the “Giveaway Website”). 

All entries must be completed (and, if applicable, received) during the Giveaway Period. Any entries completed (and, if applicable, received) before or after the Giveaway Period will not be entered into the Giveaway. 

PARTICIPATION IN THE GIVEAWAY IS VOLUNTARY AND NO PURCHASE IS NECESSARY TO ENTER OR WIN A PRIZE PACKAGE. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. 

Giveaway Period. The Giveaway begins at 12:01 a.m., PST Time, on Saturday March 1st, 2025 through 12 p.m., PST Time, on Monday March 31st, 2025 (the “Giveaway Period”). The official time for the Giveaway Period shall be determined by Sponsor’s computer systems. All dates are subject to change. 

Selection and Notification of Winners.  Throughout the campaign period, the winners of a Sleep Starter Pack (the ‘Daily Prize’) will be announced weekly on Love to Dream’s US Broadcast channel the following dates:  

  • Winners from entries submitted between the 1st of March 2025 and the 6th of March 2025 will be  announced on the 7th of March 2025.  

  • Winners from entries submitted between the 7th of March 2025 and the 13th of March 2025 will be announced on the 14th of March 2025.  

  • Winners from entries submitted between the 14th of March 2025 and the 20th of March 2025 will be announced on the 21st March 2025.  

  • Winners from entries submitted between the 21st of March 2025 and the 27th of March 2025 will be announced on the 28th of March 2025.  

  • Winner from entries submitted between the 28th of March and the 31st of March 2025 will be announced on the 4th of April 2025.  

Following the Giveaway Period, the winner of the Family Sleep Fund (the ‘Major Prize’) will be announced on April 4th 2025.

Winners will be randomly selected from entries that fully comply with the Rules. A single entrant will win the Family Sleep Fund (the ‘Major Prize’) and 31 entrants will win a Sleep Starter Pack (the ‘Daily Prize’). The potential winners will be notified by Love to Dream (the ‘Sponsor’) via e-mail as outlined above.  

The potential winners are subject to validation and verification of eligibility and compliance with the Rules, and may be required, at the Sponsor’s discretion, to provide additional information and to sign and return a liability release, a publicity release, and/or tax-related documents as a condition to being selected as a winner. The potential winners must respond to the email notification and provide all requested information and signed documents within 48 hours after the email notification is delivered. If a potential winner does not respond with the requested information and signed documents within 48 hours after the email notification is delivered, the potential winner may be disqualified and the Sponsor may select another potential winner. The first three potential winners who meet these and the other requirements set forth in these Rules, in the Sponsor’s sole discretion, will be determined by Sponsor to be the winners (“Winners”). EACH POTENTIAL WINNER IS SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE GIVEAWAY. AN ENTRANT IS NOT A WINNER UNTIL ENTRANT’S ELIGIBILITY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE AND NO FURTHER ACTION IS NEEDED. 

Winners Announcement. Upon written request directed to the Sponsor’s Contact Us page, the abbreviated name (first name and last initial) of the Winners will be available for 90 days after the end of the Giveaway Period. 

Daily Prize. Subject to the Rules, each Sleep Starter Pack (the ‘Daily Prize’) Winner will receive a prize package (a “prize package”) that includes:

Online vouchers for the items included in the prize package will be sent to winners via  email for redemption at www.lovetodream.com.  

No transfer, substitution, or cash equivalent for prizes is allowed, except in Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize, in whole or in part, of equal or greater monetary value if, for any reason, a prize cannot be awarded, in whole or in part. 

Major Prize. Subject to the Rules, the Family Sleep Fund (the ‘Major Prize’) Winner will receive USD $25,000 cash via electronic funds transfer to their nominated account within 14 days of the potential winners responding to the Sponsor email notification.  The major prize is considered taxable income under IRS law and the winner is solely responsible for meeting federal and state tax requirements according to their personal situation.  

No transfer, substitution, or cash equivalent for prizes is allowed, except in Sponsor’s sole discretion.  

Odds of Winning. Odds of winning the Giveaway will depend on the number of entries received during the Giveaway Period. 

General Conditions. All federal, state, and local laws and regulations apply to the Giveaway and the Giveaway is void where prohibited by law. Sponsor reserves the right to disqualify any entry from the Giveaway if, in Sponsor’s sole discretion, it reasonably believes that the entry was or resulted from an attempt to undermine the legitimate operation of the Giveaway by fraud, cheating, deception, or other unfair practices, or the entrant annoys, abuses, threatens, or harasses any other entrants or Sponsor. Entries using automated means of any kind are prohibited. 

Privacy. You agree that personal data submitted with an entry to participate in the Giveaway (including, without limitation, name, e-mail address, post code, due date, and/or child’s birthdate) may be collected, processed, stored, and otherwise used by Sponsor, and their affiliates for the purposes of conducting and administering the Giveaway. You also agree that any personal data submitted by you in connection with an entry may be used in connection with Sponsor’s, and their respective affiliates’, promotional, marketing, and advertising purposes. Without limitation, Sponsor and may from time to time use your personal information to send you updates about themselves and their products and services, as well as promotional materials. By entering the Giveaway and accepting the applicable terms, you fully and unconditionally agree to the terms of Sponsor’s privacy policies, links to which are provided below:

Release, Indemnification, and Acknowledgement of Disclaimer of Warranties. By entering the Giveaway, and to the maximum extent permitted by law, you agree to release, defend, indemnify and hold harmless Sponsor, each of Sponsor’s subsidiaries, affiliates, distributors, and suppliers, and their respective employees, officers, directors, agents, and representatives (the “Released Parties”) from and against any and all claims, actions, suits, proceedings, losses, liabilities, damages, fines, costs, and/or expenses (including, without limitation, reasonable attorney fees) arising out of or relating to: (i) any misrepresentation you make in connection with the Giveaway; (ii) any non-compliance by you with these Rules; (iii) claims brought by persons or entities other than the parties to these Rules arising from or related to your or other entrants’ entry into or involvement with the Giveaway; 

(iv) acceptance, possession, misuse, or use of any prize or participation in any Giveaway-related activity or participation in the Giveaway; (v) any malfunction or other problem with Instagram, Facebook, YouTube, TikTok or Sponsor’s o e-mail or computer systems in relation to the entry and participation in the Giveaway by you; (vi) any error in the collection, processing, or retention of entry in relation to the entry and participation in the Giveaway by you; or (vii) any typographical or other error in the printing, offering, or announcement of any prize or winners in relation to your entry and participation in the Giveaway. 

You further agree to release, defend, indemnify, and hold harmless Sponsor, each of Sponsor’s subsidiaries, affiliates, distributors, and suppliers, and their respective employees, officers, directors, agents, and representatives from and against any and all claims, actions, suits, proceedings, losses, liabilities, damages, injuries (including death and/or disability), property damage, fines, costs, and expenses (including, without limitation, attorney fees). 

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SPONSOR DISCLAIMS LIABILITY FOR, AND IN NO EVENT WILL THE SPONSOR BE LIABLE FOR, ANY SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF USE, LOSS OF PROFITS, OR LOSS OF DATA, WHETHER IN AN ACTION IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, ARISING OUT OF, OR IN ANY WAY CONNECTED TO, YOUR PARTICIPATION IN THE GIVEAWAY OR USE OR INABILITY TO USE ANY PRIZE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE AGGREGATE LIABILITY OF THE RELEASED PARTIES (JOINTLY) ARISING OUT OF OR RELATING TO YOUR PARTICIPATION IN THE GIVEAWAY, OR YOUR USE OF OR INABILITY TO USE ANY PRIZE, EXCEED $10. THE LIMITATIONS SET FORTH IN THIS SECTION WILL NOT EXCLUDE OR LIMIT LIABILITY FOR THE RELEASED PARTIES’ GROSS NEGLIGENCE, INTENTIONAL MISCONDUCT, OR FRAUD. 

Sponsor reserves the right, in its sole discretion and without prior notice, to suspend or cancel the Giveaway or alter these Rules for any reason, including but not limited to alteration or corruption of the administration of the Giveaway by computer virus, technical problem, or other unexpected or unforeseeable event. 

Trade Promotion Authority: TP/02035 Operators must be aware of, and abide by, all their obligations under the Community Gaming Act 2018, the Community Gaming Regulation 2020 and any other relevant Acts and Regulations related to the conduct of their authorised gaming activity. This includes but is not limited to, the Charitable Fundraising Act 1991, Gaming Machines Act 2001 and their supporting Regulations

Forum, Choice of Law, and Recourse to Judicial Procedures. These Rules shall be governed by, subject to, and construed in accordance with the laws of the State of Idaho (without regard to its choice of law provisions). You acknowledge and agree that any action relating to or arising from these Rules or the Giveaway shall be commenced and conducted only in a federal or state court with subject matter jurisdiction in Ada County, Idaho. You hereby waive any personal jurisdiction challenges and waive any arguments based on forum non conveniens. 

Miscellaneous. If any provision(s) of these Rules is held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect. The party prevailing in any suit seeking the interpretation or enforcement of any provision of these Rules shall recover its reasonable attorneys’ fees incurred.
